Terms of Service

1. Introduction

Welcome to Datesh Media & Design (“Datesh”, “we”, “our”, “us”).
These Terms of Service govern your use of our website www.datesh.co.za and all related services including web design, digital marketing, social media management, video editing, branding, and other creative solutions.

By accessing or using our site or services, you agree to be bound by these Terms. Please read them carefully before engaging with us.


2. Scope of Services

Datesh Media provides digital creative, marketing, and web-development services to clients globally. All project scopes, deliverables, and timelines are defined in written proposals, quotes, or agreements issued prior to project commencement.

We reserve the right to modify or discontinue any service, pricing, or feature without prior notice.


3. Project Engagement & Approvals

  • Projects begin only after written confirmation, acceptance of the proposal, and payment of any required deposit.
  • Clients are responsible for providing all necessary content (text, images, logins, brand materials, etc.) promptly. Delays in providing materials may result in project delays.
  • Approval of drafts, designs, or milestones signifies acceptance. Any later changes may incur additional fees.

4. Payments

  • All prices are quoted in ZAR (South African Rand) unless otherwise stated.
  • Payment terms will be clearly stated in the proposal (e.g., 50% deposit, 50% on completion).
  • Payments are processed via EFT, card, or approved payment links.
  • Projects may be paused or withheld if invoices remain unpaid beyond the due date.

Note: All creative, code, and design work remains the property of Datesh Media until full payment is received.


5. Intellectual Property

  • Upon full payment, ownership of final approved deliverables (e.g., design files, website build, videos) transfers to the client unless otherwise agreed.
  • Datesh retains the right to display completed work in our portfolio, social media, and marketing materials for promotional purposes.
  • Client-provided assets remain the property of the client, but the client grants Datesh the right to use them for fulfilling the project.

6. Confidentiality

Both parties agree to maintain confidentiality regarding all proprietary, client, and campaign information exchanged during the course of the project.


7. Limitation of Liability

While Datesh Media exercises utmost care, we are not liable for:

  • Losses arising from third-party integrations (hosting providers, ad platforms, plugins, etc.);
  • Downtime, data loss, or security breaches caused by client negligence or external services;
  • Indirect, consequential, or incidental damages related to any project or service.

Our liability is limited to the total amount paid by the client for the specific project.


8. Revisions & Modifications

All proposals include a defined number of revision rounds. Additional changes outside the agreed scope may incur extra costs at our hourly or package rate.


9. Termination of Services

Either party may terminate a project in writing. Work completed up to termination will be invoiced proportionally. Deposits are non-refundable once work has begun.


10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall fall under the jurisdiction of the Gauteng High Court.
